1. Introduction
These Terms and Conditions govern the sale, delivery, installation, servicing, repair, exchange, return and warranty of all products supplied by Sirair CC (“Sirair”, “we”, “our”, or “us”).
These Terms and Conditions apply to all retail customers, dealers, resellers, contractors, installers and commercial clients purchasing products or services from Sirair unless otherwise agreed in writing.
By purchasing any product or service from Sirair, the purchaser acknowledges that they have read, understood and accepted these Terms and Conditions.
2. Definitions
For the purposes of this document:
- Customer means the purchaser of any Sirair product or service.
- Dealer means an authorised reseller/installer/technician purchasing products for resale.
- Recommended Installer means an installer approved or recognised by Sirair and listed on the recommended installers page available on the Sirair website (www.sirair.co.za).
- Warranty means the manufacturer's limited parts warranty contained within this document.
- Working Day means Monday to Friday excluding South African public holidays.
3. Warranty Overview
This warranty is a voluntary manufacturer's warranty provided by Sirair. Where applicable, this warranty operates in addition to any rights afforded under applicable South African consumer legislation.
This warranty covers manufacturing defects only, including defects arising from:
- faulty materials;
- defective workmanship; and
- manufacturing defects.
This warranty is strictly a parts-only warranty.
Unless expressly agreed otherwise in writing, the following are excluded: labour; installation costs; de-installation costs; re-installation costs; refrigerant recovery and recharge; transport; courier charges; accommodation; scaffolding; electrical work; plumbing work; travel expenses; and any consequential or incidental losses.
Warranty approval remains subject to technical inspection by Sirair.
4. Warranty Periods

The warranty period commences from the original invoice date.
Replacement parts supplied under warranty do not extend or renew the original warranty period.
5. Service Requirements
Warranty validity is conditional upon the product being serviced at the following minimum intervals:

Failure to service the equipment within these intervals will render the warranty null and void.
Customers must retain service records and invoices as proof of maintenance. Sirair reserves the right to request these records before approving any warranty claim.
6. Installation Requirements
Products must be installed:
- by a Sirair-recommended installer;
- in accordance with the manufacturer's installation instructions; and
- in compliance with applicable South African electrical regulations and standards.
Warranty shall immediately become void where:
- installation instructions are not followed;
- incorrect pipe sizes are used;
- incorrect wiring is installed;
- incorrect commissioning procedures are followed;
- refrigerant pipework is contaminated;
- electrical supply requirements are not met;
- unauthorized modifications are made; or
- unauthorized technicians install the product.
Sirair-recommended installers operate as independent contractors and are not employees or agents of Sirair.
7. Warranty Exclusions
The warranty does not cover failures resulting from any cause other than manufacturing defects. The following are specifically excluded.
Electrical Damage
Damage caused by:
- power surges;
- load shedding;
- lightning;
- voltage fluctuations;
- under-voltage;
- over-voltage;
- generator faults;
- solar installation faults; and
- incorrect electrical supply.
Installation Related Failures
- incorrect installation;
- incorrect commissioning;
- incorrect pipe sizing;
- incorrect drainage;
- refrigerant leaks caused by installation;
- incorrect electrical wiring;
- incorrect unit sizing; and
- failure to install isolators.
Lack of Maintenance
- dirty filters;
- blocked condensers;
- blocked evaporators;
- blocked drains;
- corrosion and rust;
- coastal corrosion; and
- failure to perform scheduled servicing.
Environmental Damage
- fire;
- flood;
- storms;
- hail;
- earth movement;
- vermin, rodents, insects or animals;
- chemical exposure; and
- salt corrosion.
Misuse
- neglect;
- abuse;
- accidental damage;
- vandalism;
- misuse;
- commercial use of residential products;
- unauthorized repairs; and
- product modifications.
Components Specifically Excluded
The following components are not covered under warranty:
- Printed Circuit Boards (PCBs);
- remote controls;
- batteries;
- Wi-Fi modules;
- condensate pumps;
- cosmetic panels;
- plastic components; and
- air filters.
8. Warranty Claim Procedure
To submit a warranty claim, customers must provide:
- original proof of purchase;
- product model number;
- product serial number;
- description of the fault; and
- supporting photographs where requested.
Faulty parts must be returned to Sirair for technical assessment. Compressors must be removed and submitted for specialist evaluation before replacement approval.
Should testing determine that the returned component is free from manufacturing defects, the customer shall be responsible for:
- inspection costs;
- courier costs;
- return freight; and
- replacement costs where applicable.
Returned components remain the property of Sirair until assessment has been completed.
9. Call-Out Policy
Call-out charges apply where:
- no manufacturing fault is found;
- the reported fault is installation-related;
- the reported fault falls outside warranty coverage;
- access to site is unavailable;
- appointments are cancelled after technician dispatch; or
- the customer requests non-warranty work.
Units located more than 40 km from Sirair's Midrand office will incur travel charges at the prevailing AA rate for every kilometre exceeding the initial 40 km.
Call-outs are scheduled only after payment has been received and reflected where charges apply.
A responsible adult must be present during all site visits.
10. Payment and Installation Terms
Unless otherwise agreed in writing:
- full payment, which must reflect in Sirair's account, is required before installation is scheduled;
- installation dates remain provisional until payment has cleared; and
- standard installation scheduling is within four working days after payment confirmation.
Standard installations exclude:
- electrical work;
- plumbing;
- patching;
- painting;
- ceiling repairs;
- core drilling beyond standard scope; and
- unit relocation after installation.
Additional labour, scaffolding, cranes or specialised lifting equipment will be quoted separately.
Ownership of all goods remains with Sirair until payment has been received in full.
11. Spare Parts Policy
No returns or refunds are accepted on:
- spare parts;
- electrical components;
- PCBs;
- compressors; and
- refrigerant.
When ordering spare parts customers must provide:
- original invoice;
- product model;
- serial number; and
- clear photograph of the required component.
Incorrectly ordered parts remain the customer's responsibility.
12. Customer Responsibilities
Customers are responsible for:
- maintaining valid proof of purchase;
- retaining service records;
- providing safe access;
- providing adequate electrical supply;
- ensuring correct unit sizing;
- installing suitable surge protection where necessary;
- maintaining unobstructed airflow; and
- collecting purchased goods within seven days where collection applies.
Failure to comply may invalidate warranty coverage.
13. Cancellation and Conduct Policy
Sirair reserves the right to suspend or terminate any installation, service visit, warranty assessment or technical support where any employee, contractor or representative is subjected to:
- threats;
- intimidation;
- harassment;
- verbal abuse;
- physical abuse;
- discriminatory language; or
- unsafe working conditions.
Applicable charges incurred prior to cancellation remain payable.
14. Delivery Policy
Sirair offers nationwide delivery through approved third party courier and freight providers. This service is billed accordingly.
Estimated delivery times are 3 to 7 working days, subject to stock availability and destination. Delivery estimates exclude weekends, public holidays, and the annual shutdown period between 21 December and 2 January. Delivery dates are estimates only and are not guaranteed.
Customers must inspect all goods before signing the delivery note. A signed delivery note marked “Received in Good Order” confirms that the goods were received without visible damage and that risk passes to the customer upon acceptance.
Customers must refuse delivery where visible transit damage exists. Sirair accepts no liability for damage caused by third-party courier companies after goods have been accepted.
Deliveries cannot be made to PO Boxes. A responsible adult with valid identification must accept delivery.
15. Return and Exchange Policy
Exchange Conditions
Products may only be exchanged where:
- unused;
- unopened;
- in original packaging;
- all labels, straps and seals remain intact; and
- all accessories are included.
Exchange requests must be lodged within seven calendar days of collection or delivery.
Returns must be delivered to the Sirair Midrand branch at the customer's expense.
Products purchased on promotion or special are not eligible for exchange unless required by applicable law.
Return Conditions
Returns are subject to inspection and approval.
- Installed products cannot be returned.
- Opened products cannot be returned.
- Used products cannot be returned.
- Custom-ordered products cannot be returned.
No returns will be accepted for: spare parts; electrical components; PCBs; compressors; and refrigerant.
Installation cancellations after technician dispatch will incur the applicable call-out charge.
Approved refunds will be processed within 14 working days after inspection and approval. Noting refunds only occur to the invoiced party and may not be processed to any other party involved in the transaction.
Bank processing times remain outside Sirair's control.

16. Limitation of Liability
To the fullest extent permitted by law, Sirair shall not be liable for: loss of profits; business interruption; loss of income; loss of production; damage to third-party property; loss of refrigerant; accommodation costs; rental of temporary equipment; consequential losses; indirect damages; special damages; and incidental damages.
17. Force Majeure
Sirair shall not be liable for any delay or failure to perform its obligations arising from circumstances beyond its reasonable control, including but not limited to: acts of God; floods; fires; lightning; civil unrest; strikes; supplier shortages; import delays; government restrictions; transport disruptions; and epidemics or pandemics.
18. Governing Law
These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
Any dispute arising from these Terms and Conditions shall be subject to the jurisdiction of the competent courts of South Africa.
19. Entire Agreement
These Terms and Conditions constitute the entire agreement between Sirair and the purchaser relating to the sale, installation, servicing, delivery, warranty and return of products unless varied in writing and signed by an authorised representative of Sirair.
Should any provision of these Terms and Conditions be declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Acceptance
By purchasing any product or service from Sirair, the customer acknowledges that they have read, understood and accepted these Terms and Conditions of Sale, Delivery, Returns and Warranty.
